Liability Waiver *

Volunteer Acknowledgement and Agreement

This Volunteer Acknowledgment and Agreement is between Jones Center for Families and Jones Trust (herein collectively referred to as “Jones Center”), and the undersigned volunteer.

I, the undersigned volunteer, acknowledge and agree as follows:

Voluntary Participation

I am voluntarily participating in volunteer activities with Jones Center. I understand that my participation is entirely voluntary and that I may discontinue my service at any time. I further understand that Jones Center may end my volunteer service at any time, with or without notice.

Assumption of Risk

I understand that volunteer activities may involve physical activity, use of facilities or equipment, interaction with participants of all ages, and exposure to conditions that may be hazardous or unpredictable. I knowingly and voluntarily assume all risks, both known and unknown, associated with my participation, including the risk of personal injury, illness, death, or property damage.

Release and Waiver of Liability

To the fullest extent permitted by law, I release and discharge Jones Center, its officers, directors, employees, agents, volunteers, donors, sponsors, partners, affiliates, contractors, vendors, service providers, and any organizations with which Jones Center has a contractual relationship that support or assist volunteer activities at any Jones Center location, as well as any tenants of Jones Center that support or assist volunteer activities on behalf of Jones Center, and each of their respective officers, directors, employees, agents, and volunteers, from any and all claims, demands, causes of action, or liability arising out of or related to my volunteer activities, including claims resulting from the negligence of Jones Center or any of the released parties.

Indemnification

I agree to indemnify and hold harmless Jones Center from any claims, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or related to my actions or omissions while participating as a volunteer.

Medical Responsibility and Insurance

I understand and agree that Jones Center does not provide medical, accident, health, or liability insurance coverage for volunteers. I am solely responsible for any medical costs, treatment, or expenses incurred as a result of injury or illness arising out of or related to my volunteer service.

I further understand that I must rely exclusively on my own personal insurance coverage, if any, and that Jones Center has no obligation to provide insurance coverage or reimbursement of any kind.

No Employment Relationship

I understand that my service as a volunteer does not create an employment relationship with Jones Center. I am not entitled to wages, benefits, workers’ compensation, or any other employment-related benefits.

Photography and Media Release

I grant permission to Jones Center to use photographs, video, or other media images of me taken during volunteer activities for lawful purposes, including marketing, educational, and promotional uses, without compensation. I waive any right to inspect or approve the final use of such media.

Volunteer Conduct, Confidentiality, and At Will Service

I understand that it is prohibited for me to remove any Jones Center property, product, equipment, or confidential information, including files, forms, emails, and other written or electronic documentation, for any personal use. I agree to maintain the confidentiality of all nonpublic information obtained through my volunteer service.

I understand that my volunteer service with Jones Center is at will and may be terminated at any time, for any reason or for no stated reason, with or without advance notice. I further understand that Jones Center may modify, revoke, or change volunteer policies and guidelines at any time, in its sole discretion, and that such policies are intended as guidelines only and do not create any contractual rights.

Governing Law and Venue

This agreement shall be governed by the laws of the State of Arkansas. Any legal action arising from this agreement shall be brought in a court of competent jurisdiction located in Benton County, Arkansas.

Severability

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgement of Understanding

I acknowledge that I have read this agreement carefully, understand its terms, and sign it freely and voluntarily.
